Explaining Europe
I pay for Ben Thompson’s Stratechery newsletter, and normally enjoy it, but like most commentators, he does have his biases.
In his latest free update he takes issue with the EU’s latest forays into regulating tech firms, and specifically the objection to the “pay or consent” system, where users are given the choice between accepting Facebook/Meta’s tracking, or paying €12.99 a month. Ben writes:
there is no universe where a non-personalized version of Meta’s products are [sic] “equivalent” to a personalized version from a business perspective. Personalized ads are both far more valuable to advertisers, who only want to advertise to potential customers, not the entire Meta user base, and also a better experience for users, who get more relevant ads instead of random nonsense that isn’t pertinent to them. Indeed, personalized ads are so valuable that Eric Seufert has estimated that charging a subscription in lieu of personalized ads would cost Meta 60% of its E.U. revenue; being forced to offer completely un-personalized ads would be far more injurious.
This whole paragraph is one giant unfounded assertion. It is far from clear that targeted ads give a better experience to users; speaking for myself, I only ever see either super-generic ads that do not take advantage of any of the tracking data, or creepily over-targeted ones like those T-shirts that are obviously just cross-referencing a couple of the user’s own revealed interests. It’s never “someone finally figured out a USB-C cable that’s good actually”; I have to find that on my own.
Things are no better for advertisers, though, and the marks are beginning to push back. For many advertisers, broad reach is preferable to micro-targeting — and for others, the level of spam in the platforms makes targeting unattractive anyway.
Basically, surveillance adtech is good for platforms like Meta, who extract all of the value in this ecosystem, so it is obvious why Meta would want to charge ridiculous fees for users wanting to opt out. This is of course why the EU is threatening eye-watering fines, because it’s the only way to get these platforms’ attention, as was proved with the GDPR. But Ben also objects to those:
the more “moderate” punishment could be ten percent of Nvidia’s worldwide revenue, despite the fact that France — and almost certainly the E.U. as a whole — provide nowhere close to ten percent of Nvidia’s revenue.
Like many other US commentators, Ben devolves into a pretty narrowly mercantilist argument:
the European Union is threatening to fine these U.S. tech giants more money than they make in the E.U. market in a year!
The first thing to note is that the very existence of these threats should be considered outrageous by the U.S. government: another international entity is threatening to not just regulate U.S. companies within their borders (reasonable!), but to actually take revenue earned elsewhere in the world.
This is of course the same Ben Thompson who rails against TikTok because it is an arm of the Chinese state — a criticism which also get levelled against the likes of Huawei, to the point of a ban that is so stringent that it causes problems even for the US Defense Department. The rest of the world has had to put up with foreign (US) tech firms that refuse to be regulated or taxed in the markets in which they operate, but this is still a relatively new experience for Americans.

I would love to know if it is possible for any non-U.S. government to respond to any number of unique conditions created by massive technology companies without it disproportionately impacting U.S.-based firms. The U.S. spent decades encouraging a soft power empire in the tech industry with its lax competition laws, and it has been an immensely successful endeavour.
A previous instance of this transatlantic conflict is the German publishers’ series of lawsuits against Google, which can also be seen as an early appearance of the fundamental conflict of business models around “AI”.
The one thing “AI” appears to be pretty good at is summarisation, but there is a fundamental difference between “summarise the Meta T&C document to tell me what they actually propose to do with my data and what options I have” and “summarise this news article / opinion piece / blog that someone wrote and is hoping to be compensated for”. In the same way, it is one thing for Google to list the description of an article that a publisher has provided in the article header, but it is quite another to excerpt big chunks of it, or to digest it to be used as part of an uncredited “AI”-generated summary.
The original sin of publishers was to buy in to the promise of the adtech middlemen, who promised easy revenue for their online operations. The problem is that in a world of micro-targeting, big-brand destination sites inevitably get fleeced. The name of the game is identifying someone who reads the NYT, and then (this is the key) advertising to them somewhere far cheaper. There is literally no way for the NYT to win in that scenario — which is why the NYT actually built its own in-house ad unit using its own data.
None of this is new, mind; I have written about this before. It’s just jarring when someone who I normally regard as a voice of reason gets this strident in defense of a company and a practice that they have criticised in the past.
It is particularly important to get these topics right as various governments are considering legislation about “AI”. If this turns into a protectionist turf war, whoever wins, the ones who are guaranteed to lose are the users.
